1Introduction and Acceptance

Welcome to Ludicycle! These Terms and Conditions ("Terms") govern your use of the Ludicycle mobile application, website, and services (collectively, the "Platform") operated by Experiatech ("we", "us", or "our"), located at 360 Rue Saint-Jacques, Montreal, QC H2Y 1P5, Canada.

2Definitions

To help you understand these terms, here are some important definitions:

Platform

the Ludicycle mobile application, website, and all related services.

User or Customer

any individual who creates an account to purchase products.

Store or Store Owner

any business registered on our Platform to sell products.

Products

toys and related items listed for sale on our Platform.

Order

a purchase made through the Platform.

Pickup Code

the 6-digit code provided for order collection.

3Account Registration and Eligibility

To use our Platform, you must:

• Be at least 18 years old or the age of majority in your province
• Provide accurate and complete registration information
• Maintain the confidentiality of your account credentials
• Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4User Responsibilities

As a user of our Platform, you agree to:

• Use the Platform only for lawful purposes
• Not create multiple accounts or share account credentials
• Provide accurate information for orders and payments
• Pick up orders within the specified time window
• Treat store staff with respect during pickup
• Not resell products purchased through the Platform for profit
• Not attempt to manipulate prices, ratings, or reviews

5Store Owner Terms

If you register as a Store Owner, you additionally agree to:

• Provide accurate business information and documentation
• List only products that comply with applicable laws and safety standards
• Maintain accurate inventory and pricing information
• Fulfill all confirmed orders in a timely manner
• Provide a safe and accessible pickup location
• Comply with all applicable consumer protection laws
• Not list counterfeit, recalled, or unsafe products

6Product Listings and Purchases

Products listed on our Platform are sold by independent stores. While we facilitate transactions, we are not the seller of these products.

• Product descriptions and images are provided by stores
• Prices include applicable discounts as displayed
• Availability is subject to change without notice
• We do not guarantee the quality, safety, or legality of products

By making a purchase, you enter into a direct agreement with the store selling the product.

7Pricing and Payments

All payments are processed securely through Stripe. By making a purchase, you agree to:

• Pay the listed price plus any applicable taxes
• Provide valid payment information
• Authorize us to charge your payment method

All prices are displayed in Canadian dollars (CAD) unless otherwise specified.

8Order Pickup and Codes

After completing a purchase, you will receive a 6-digit pickup code. To collect your order:

1. 1Visit the store during the specified pickup window
2. 2Present your pickup code to the store staff
3. 3Verify your order before leaving the store

Pickup codes expire after 48 hours or as specified in your order confirmation. Expired codes cannot be redeemed.

9Cancellations and Refunds

Our cancellation policy is as follows:

• Orders can be cancelled within 2 hours of purchase for a full refund
• After 2 hours, cancellations are at the store's discretion
• No refunds are provided for picked-up orders
• If a store cannot fulfill an order, you will receive a full refund

10Intellectual Property

The Platform, including its design, logos, content, and features, is owned by Experiatech and protected by Canadian and international intellectual property laws.

• You may not copy, modify, or distribute our Platform or content
• You may not use our trademarks without written permission
• User-generated content remains your property, but you grant us a license to use it

11Prohibited Activities

The following activities are strictly prohibited:

• Violating any applicable laws or regulations
• Impersonating others or providing false information
• Interfering with the Platform's operation or security
• Scraping, data mining, or automated access
• Harassment, abuse, or threatening behavior
• Fraudulent transactions or payment chargebacks
• Circumventing fees, limits, or restrictions

12Disclaimers and Limitation of Liability

• The Platform is provided "as is" without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• We are not liable for actions of stores or other users
• We are not responsible for product quality, safety, or fitness

13Indemnification

You agree to indemnify and hold harmless Experiatech, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Your interactions with stores or other users

14Governing Law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Quebec, located in Montreal.

15Dispute Resolution

Before initiating legal action, you agree to:

1. 1Contact us at support@ludicycle.com to resolve the dispute informally
2. 2Allow 30 days for us to respond and attempt resolution
3. 3Participate in good faith negotiations

If informal resolution fails, disputes may be submitted to mediation before proceeding to court.

16Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting notice on the Platform
• Sending email to your registered address
• Requiring acceptance of new terms on next login

Continued use after changes constitutes acceptance. If you disagree with changes, you must stop using the Platform.
